Landlord Legal Requirements — What You Need to Know

The Smoke and Carbon Monoxide Alarm (Amendment) Regulations 2022 require landlords in England to ensure a smoke alarm is fitted on every floor of the property where there is a room used as living accommodation, and a carbon monoxide alarm in every room containing a fixed combustion appliance (excluding gas cookers). Landlords must ensure all alarms are in working order at the start of each new tenancy.

These regulations apply to all residential tenancies in England including private rentals, HMOs, and short-term lets. Local councils have enforcement powers and can issue remedial notices requiring compliance within 28 days. Non-compliance can result in a civil penalty of up to £5,000.

Alarm Types and Placement

Smoke Alarms — Where Required

One on every floor where there is a habitable room. In practice: hallways on each storey, and landing or bedroom corridors. Optical alarms are recommended for sleeping areas as they respond better to slow smouldering fires. Ionisation alarms are better for kitchens where fast-flaming fires are more likely, but are more prone to false alarms from cooking.

CO Alarms — Where Required

In every room containing a fixed combustion appliance — gas boiler, gas fire, log burner, oil-fired appliance. Not required for gas cookers under the current regulations, but recommended. CO alarms should be placed at head height approximately 1–3 metres from the appliance.

10-Year Sealed Battery Units

For landlords who want to minimise ongoing maintenance, 10-year sealed battery alarms are available. The sealed battery matches the unit's operational life, eliminating annual battery replacement. The unit is replaced rather than re-batteried at end of life.

Heat Alarms for Kitchens

Standard smoke alarms in kitchens trigger frequently from cooking. A heat alarm is better suited to kitchen use — it responds to temperature rise rather than smoke and is less prone to nuisance activations while still providing fire detection.

Portfolio Servicing for Landlords

Test alarms at the start of every tenancy — not just annually

The 2022 regulations require alarms to be working at the start of each new tenancy, not just once a year. A mid-tenancy inspection visit from Multrex covers this requirement and provides a documented record.

Replace units at 10 years — not just batteries

Smoke and CO alarm sensors degrade over time. Most manufacturers specify a 10-year operational life for the unit itself, regardless of battery condition. Check the manufacture date on the back of each alarm.

Don't paint over alarms

Paint clogs the detection chamber and can prevent the alarm from responding. If an alarm has been painted over, it needs replacing — it is no longer fit for purpose regardless of battery condition.
